Journal Article 2022 05 30 This research aimed to provide a scientific and practical model for understanding the nature of liability insurance contracts in sports so that the elements of sports (managers, coaches and athletes) are aware of the need to have insurance coverage for accidents and injuries that may be possible for sports people, especially athletes. Since the research does not require sampling and interviews, data collection and analysis has been done in a library method, and it has been tried to study the perspective of the courts and judicial procedure. The results showed that insurance obligations for the loss of victims caused by sports accidents should be examined from the perspective of professional sports, so that before concluding an insurance contract, all possibilities for insurance coverage are considered by coaches and managers of sports teams and clubs and even national teams. The main question is: to what extent is the scope of responsibility of insurance providers in sports venues in front of the victims and what are the elements of responsibility in sports? Based on the results, if people have an accident while using sports facilities and performing exercises and competitions, the management of the complex is responsible for compensating the damage according to the laws, Provided that, firstly, there are elements of the time and place of the competition in the sports incident, and secondly, there is civil liability based on the theory of risk. هدف از انجام تحقیق حاضر ارایه الگویی علمی و کاربردی به منظور شناخت ماهیت قراردادهای بیمه مسئولیت در ورزش است تاارکان ورزش (مدیران، مربیان و ورزشکاران) با آگاهیاز لزوم برخورداری از پوشش بیمهحوادثوآسیب‌هاییکه احتمالا برایاهالیورزشبهخصوصورزشکارانممکن بوجود آید آگاه گردند.از آنجائی که تحقیق حاضر نیازی به نمونه گیری و مصاحبه ندارد از اینرو تحلیل داده ها به طریقه توصیف و تحلیل به روش کتابخانه ای انجام شده است و سعی شده دیدگاه محاکم و رویه قضائی در اینگونه پرونده ها چگونه میباشد.نتایج تحقیق نشان داد تعهداتبیمهدرخسارتزیان‌دیدگانناشیازحوادثورزشی لازم است از منظر ورزش حرفه ای مورد بررسی قرار گیرد تا قبل از انعقاد قرارداد بیمه تمامی احتمالات ممکن برای پوشش بیمه ای مورد توجه مربیان و مدیران تیمها و باشگاههای ورزشی و حتی تیمهای ملی قرار گیرد تا در زمان مواجهه با حوادث شرکتهای بیمه از پرداخت خسارت خودداری ننمایند. سوال اصلی که در این تحقیق مطرح شده است این بوده است که دامنه مسئولیتمتعهدان بیمه در اماکنورزشی در مقابل زیان دیدگانتاچه میزان است؟و ارکان تشکیل دهنده مسئولیت در ورزش چه میباشد؟ بر اساس نتایج تحقیق چنانچه افراد در زمان حضور و استفاده از اماکن ورزشی و انجام تمرینات و مسابقات، دچار حادثه منجر به صدمات جسمانی شوند و مدیریت مجموعه طبق قوانین، مسئول جبران خسارت وارده شناخته شود خسارت جبران می گرد به شرط آنکه اولا عناصر زمان و مکان مسابقات در حادثه ورزشی وجود داشته باشد و ثانیا عناصر سه گانه مسئولیتمدنی بر اساس نظریه خطر نیز وجود داشته باشد. https://arsmb.journals.pnu.ac.ir/article_9432_9bef98cceabb69df6d11e622f154107e.pdf
